META] Rules about private servers ?

First time here. I just wanted you to know that I am new to this site. It looks amazing.

I have a question to ask about private servers, so I checked the rule if it was allowed, and it says "Links and information about private servers" aren't allowed. Is it just server advertising, or can we have all kinds of discussion?

This post can, of course, be deleted if necessary. Won't be complaining about it since I already knew when I thought about posting this that it could be controversial.

They are allowed to be discussed but not linked to or named. It's also prohibited to encourage others to use them.

Since when can we allow people to discuss illicit activities? Private servers are running stolen code, which is illegal in the United States. Not just "Blizzard doesn't allow it," but "the United States government doesn't allow it." You can be sued for operating a private server. Blizzard could also sue you for playing on one. So why do we allow this scum on our servers?
